Public Knowledge, Mozilla, the Benton Foundation, INCOMPAS and others challenging the FCC's Restoring Internet Freedom order say that was not just bad policy but illegal.

Related: Pai Says Net Neutrality Doom and Gloom Predictions Were Baseless

That is coming in a brief with the U.S. Court of Appeals for the D.C. Circuit, which is hearing their challenge to the network neutrality reg rollback--the deadline for initial briefs from non-government parties is Aug. 20. The brief has yet to be made public, but Public Knowledge outlined the highlights.

That group and the others have long argued the FCC was making bad policy decisions when the Republican majority last fall voted to repeal the rules against blocking, throttling and paid prioritization and the title II common carrier regime that underpinned them.

Related: Court Sets Net Neutrality Briefing Schedule

But they also say that decision, under chair Ajit Pai, "broke the law," which is why the court must reverse it and restore the regulations.

Their argument is that the FCC decided the agency lacked all jurisdiction over the internet, a radical move that defined the statute, they say. Also in the "illegal" category, they argue was what they said was the FCC's "cherrypicking" of investment evidence to justify their predetermined outcome of reversing the Title II classification.

The FCC majority said one reason for the reversal was that Title II had discouraged investment, including in broadband buildouts to rural and unserved areas. Public Knowledge et al. argue that the FCC ignored evidence to the contrary in conducting a cost-benefit analysis that only benefited their "ideological preference."

“If the current policy stands, consumers can expect higher bills and fewer online choices, with fewer expressive and creative outlets, they told the court. "Ultimately, the internet will look more and more like the overpriced cable TV bundles of decades past."

Ajit Pai told legislators last week in an FCC oversight hearing that such predictions were "chicken little" fear mongering that had not materialized. Some Senate Dems suggested that was because ISPs were laying low until the court case was settled before flexing their newfound blocking and throttling and degrading muscles.

ISPs say that is not going to happen, and that if any of it does and is anticompetitive, the Federal Trade Commission and Justice Department can prevent that through investigations and lawsuits.

Video-sharing website Vimeo is telling supporters that the FCC is planning to “repeal” net-neutrality rules and, if that happens, the internet will “start to resemble an old, rigid (vanilla) cable TV system, instead of the open (and ‘weird’) network that we know and love.”

The Federal Communications Commission has yet to announce exactly what it will do with the Tom Wheeler-era rules, but it is a pretty safe bet some of them are going and that Title II reclassification of ISPs will be rolled back, given the Republican majority’s distaste for Title II.

Vimeo's website is participating in the July 12 Internet Action Day to protest FCC chair Ajit Pai’s proposal to reclassify internet access, wired and wireless, and interconnections, as an information service not subject to Title II common-carrier regulations, as well as to eliminate the general conduct standard and reconsider whether the bright-line rules against blocking, throttling and paid prioritization are necessary.

Organizer Fight for the Future said more than 50,000 people, sites or organizations are participating in Internet Action Day. Vimeo is one of a host of edge providers participating in the protest — Amazon, Etsy, Mozilla and Netflix are as well — and it's marshaling its online video resources to make its case.

"Participating" includes posting homepage messages, push notifications, videos, email campaigns and more, by some of the same groups behind the Internet Slowdown protest that helped defeat online piracy legislation (SOPA, PIPA) despite previous bipartisan Hill support.

For its part, Vimeo reached out to the producers who make its monthly “Staff Pick” videos of content that Vimeo staffers “really, really like” to create a Why We Need Net Neutrality video to say why they really, really like the Internet under Title II.

Initial comments on Pai's net-neutrality rule proposal are due July 14.

At the closing General Session at INTX: The Internet & Television Expo here Thursday she added that can be a mixture of both short-form and long-form shows.

“We believe in our brands and the service we provide to consumers,” Dubuc said. “We are constantly reiterating our brands, constantly reacting to consumer tastes.”

Dubuc said that surprisingly, there is very little overlap between A+E’s non-linear and linear programming, adding that its online content isn’t necessarily geared toward driving viewers back to the traditional cable channel.

“We’re marketers,” Dubuc said. “We are going to go to the platform where we can create a branded platform for our viewers.”

Dubuc wouldn’t comment on plans to give online pioneer Vice its own A+E channel. She said that A+E is an investor in the content provider, but wouldn’t comment further.

“I hope Shane [Smith, Vice founder] gets his own channel,” she said.

Vimeo CEO Kerry Trainor said his company approaches online video differently, selling individual content to users in long and short-form chunks for varying prices. Vimeo is launching a subscription VOD offering soon but it will be only for individual channels.

“We’re seeing the viewer diet evolve in real time,” Trainor said. “We see people are consuming longer form pieces of content, and with the launch of Vimeo on Demand, feature length films, documentaries, episodics; everything from single minutes to close to a half hour.”

Now that digital-content provider Vimeo has moved its first original series to HBO, the company is looking for its next big original online hit series.

High Maintenance, a comedy about a marijuana delivery messenger just acquired by HBO, was Vimeo’s first stab at the original series arena. The series — created by Ben Sinclair and KatjaBlichfield— initially launched on Vimeo for free before moving to the online video provider’s subscription on-demand platform for its second season.

HBO will develop six new episodes of High Maintenance and will run its 19 prior episodes on the HBO Go and HBO Now platforms.

“High Maintenance has proven to be one of today’s most highly-acclaimed online comedies,” HBO programming president Michael Lombardo said in a statement. “We are thrilled to bring this sophisticated and clever series to our HBO audience.”

High Maintenance follows the adventures of “The Guy,” a nameless marijuana dealer played by Sinclair, as he delivers his product to clients in New York City. Each episode focuses on a different set of characters and how they interact with the unnamed dealer.

“We didn’t create the show thinking that it will be sold to HBO, but we’re thrilled with how it turned out,” Vimeo general manager Greg Clayman told Multichannel News. “We’ve talked about the emergence of various platforms, so it’s really interesting to see a high-quality show like that make its way across the various platforms — first it was free, then it was on demand and now it’s on HBO.”

Clayman said Vimeo doesn’t have another original series lined up as of yet but is talking to several producers about various projects.

For Vimeo, which has more than 170 million unique users uploading and viewing original video content, its service provides an open platform for all types of videos. The service’s Vimeo On Demand content allows its premium VimeoPRO users to charge a fee for viewing of their original movies, shows and documentaries.

Clayman said the service’s hybrid free offering and transactional on-demand package is not unlike that of the cable bundle which features both a large package of channels and premium content for consumers to choose to watch on various platforms.

He pointed to Dish’s Sling TV digital subscription package as an iteration of the mix of traditional linear content and digital presence that will reach a large swath of customers on whatever platform they choose to watch.

“It’s interesting to watch all the different flavors of online and cable content that we currently have in the marketplace,” Clayman said. “Often people talk about cable versus online but then you have Dish, which is a [multichannel video programming distributor] but also offers an online product. Instead of one over the other, we’re seeing a merger of the two as quality content finds its way to audiences.”
