                                <p>Sen. <a href="https://www.nexttv.com/tag/ed-markey">Ed Markey</a> (D-Mass.) plans to introduce legislation to reclassify broadband as a Title II service, which would subject it to common-carrier rules, restore the Federal Communication Commission‘s oversight of broadband access and reverse the Republican FCC‘s elimination of net neutrality rules.<br><br>If Democrats want a legislative net neutrality rule restoration they may have to get it done before the 2022 midterms and a potential reversal of political fortunes.<br><br>Markey said during <a href="https://www.nexttv.com/news/fccs-rosenworcel-navigates-issue-heavy-nomination-hearing">Wednesday‘s (Nov. 17) renomination hearing for FCC acting chairperson Jessica Rosenworcel</a> that he intended on introducing a bill to “end this ping-pong between administrations“ and make it explicit that broadband is a Title II service. Currently it is classified as a Title I information service not subject to common-carrier regulations.</p><p><a href="https://www.nexttv.com/news/fccs-rosenworcel-pledges-to-re-examine-video-programming-marketplace">Also: FCC’s Rosenworcel Pledges to Re-Examine Video Programming Marketplace</a><br><br><a href="https://www.nexttv.com/news/markey-net-neutrality-bill-wolf-sheeps-clothing-137157">Markey said</a> he hoped that the reclassification could be done on a bipartisan basis but also recognizes that is almost certainly a nonstarter, adding, “Perhaps that will not be the case.”<br><br>Earlier in the hearing, Sen. John Thune (R-S.D.) had said he also supported a legislative fix. Some Republicans in both the House and Senate have supported restoring net neutrality rules legislatively, just definitely not under Title II common-carrier rules that they fear could morph into mandatory access and rate regulation.</p><p>During the hearing, Rosenworcel said she still supported net neutrality rules and when pressed by Title II-backed rules opponent Sen. Roger Wicker (R-Miss.), said she would provide him with examples of how the lack of such rules hurt consumers. Wicker and others have pointed to NCTA data showing how much better the U.S., with the investment boost it argued came after the net neutrality rules were rolled back, handled the pandemic-driven broadband load versus some European countries with net neutrality rules.<br><br>Rosenworcel said the FCC always had to look at the investment record, but that the implication of the rules rollback were broader, including taking broadband oversight away from the FCC and how the pandemic demonstrated how vital broadband was, and so also how important it was to have some oversight.</p><p>But when asked by Thune whether she would commit to seeking advice from Congress before doing anything on net neutrality rules, Rosenworcel would make no such promises. She said the FCC had the authority to restore the rules. She said that if it did look to do that it would need to take into account the increased importance of broadband in the pandemic. She did pledge to work with the committee.<br><br>Markey asked her specifically if she supported reclassifying broadband as a Title II service (which subjects it to common carrier rules including mandatory access), she appeared to say yes though Markey asked if she supported reinstating net neutrality rules and restoring Title II classification and she said, “Yes, I support net neutrality.’<br><br>Markey said if his bill did not make pass, he agreed the FCC had the authority to restore Title II, though of course that would mean yet another volley of that ping-pong ball that could come back as Title I once again in a future Republican Administration. ■</p>

                                <p>Sen. Ed Markey (D-Mass.) wants the Federal Trade Commission to issue comprehensive guidelines for online conferencing services as the use of those to bridge physical distancing proliferate during the pandemic. </p><p>"A growing number of incidents over the past several weeks have revealed that these technologies may expose their users to significant cybersecurity and privacy risks," said Markey.  </p><p>With Zoom becoming a verb, he said, "individuals are increasingly vulnerable to cyber-attacks and inappropriate access of their personal data,” he <a href="https://www.markey.senate.gov/imo/media/doc/FTC%20Online%20Conferencing%20Services%20Guidelines.pdf">wrote FTC chairman Joseph Simmons</a> and the the other commissioners. </p><p>In addition to guidance for companies, Markey also wants the FTC to develop best practices for users of the conference services to help them decide when and how to user them. </p>

Ed Markey (D-Mass.) has written Comcast Chairman Brian Roberts asking for assurances that viewers in the Boston DMA will continue to have "reliable" access to NBC content free, over-the-air after it ends its affiliation with WHDH there starting in January.</p><p>Markey cited reports that NBC would use a New Hampshire transmitter and perhaps a low-power TV in Boston to deliver the over-the-air signal.</p><p>Markey said he was concerned that when NBC launches its station in January some Massachusetts communities and others will no longer have that reliable access.</p><p>He says seniors, low-income residents and cord-cutters could be "particularly impacted" by the move if there is a reduction in coverage.</p><p>"As a longtime supporter of fee, over-the-air local broadcasting," Markey said, "I strongly encourage you to ensure that all residents in the Boston DMA enjoy the same quality and reliability of free, over-the-are NBC content.</p><p>Markey asked Roberts for info by Dec.12 on 1)  what transmitter NBC will be using; 2) whether it will be ready by January, 3) how many Boston DMA households will receive "reliable indoor and outdoor antenna coverage," 4) what communities, if any, will not enjoy that same access, and 5) how is NBC letting viewers know of the change.</p><p>“WBTS (8.1) and WNEU (60.2) are currently operating and airing the Countdown NBC station," said Comcast in a statement. "We will be providing additional detail in our response to Senator Markey’s letter.”</p>

                                <p>The wireless cramming issue may be migrating to wired broadband bills in general, with a push from Sen. Ed Markey (D-Mass.).</p><p>At a Senate Commerce Committee hearing on wireless cramming, the senator asked FCC and FTC witnesses whether they were looking into cramming on bundled bills and whether that is an emerging problem, saying "cramming was scamming" wherever it occurred.</p><p>FCC acting Enforcement Bureau chief Travis LeBlanc said that crammers were predators and wherever consumers had bills they were likely to "pop up." He pointed out that to the extent the FCC was looking into wireless bills that included broadband, but Markey pressed him about broadband bills in general, not just mobile.</p><p>LeBlanc pointed out that the FCC had last week issued an advisory to ISPs about mobile and broadband network transparency and said the FCC was going to focuse enforcement "in that area."</p><p>Democratic FCC commissioner Terrell McSweeny said that she believed the FTC has authority to protect consumers from fraud and that that extends to the mobile environment "and beyond," just as it does in the brick and mortar world.</p><p>LeBlanc also said the FCC was looking at promulgating an item on revised cramming rules in the next couple of months that would include asking whether it should block all third-party billing or apply the same truth-in-billing standards that apply to landline service. LeBlanc said he thought the FCC had the authority to do so.</p><p>It is hard to talk about communications in Washington these days without bringing up network neutrality, and the cramming hearing was no exception.</p><p>Michael Altschul, senior vice president and general counsel of CTIA-The Wireless Association pointed out, when prompted, that his organization has filed comments at the FCC questioning whether it has the authority to impose those regs. He said that without detouring into the network neutrality debate, he said that the FCC was citing Title II common carrier authority for possible bill regs, and whether billing for a noncommunications service as a telecom "could stand to be clarified."</p><p>In commenting on the hearing, Consumers Union also said that cramming regs should extend to VOiP bills as well as mobile wireless and landline.</p>
