                                <p>U.S. District Court Judge George Daniels dismissed a harassment suit brought by former Fox News Channel host Andrea Tantaros against her former employer, claiming she failed to back up her allegations with actual evidence.</p><p>The dismissal comes days after Fox News named <a href="https://www.nexttv.com/news/suzanne-scott-named-fox-news-fox-business-network-ceo" data-original-url="https://www.multichannel.com/news/suzanne-scott-named-fox-news-fox-business-network-ceo">Suzanne Scott as CEO</a> and a few days after the network <a href="https://www.nytimes.com/2018/05/15/business/media/fox-news-discrimination-lawsuits.html">settled a number</a> of racial and gender discrimination lawsuits involving 18 current and former employees for $10 million. </p><p><a href="https://www.nexttv.com/tag/andrea-tantaros" data-original-url="https://www.multichannel.com/tag/andrea-tantaros">Tantaros</a> filed the "digital harassment" suit against Fox News and its former chairman Roger Ailes and former president William Shine in April 2017, alleging that executives turned on the pressure after she filed a suit in August 2016 claiming sexual harassment by Ailes and former O’Reilly Factor host Bill O’Reilly. </p><p>As part of the April suit, Tantaros claimed that Fox executives approved the hacking of her personal computer, physical surveillance and secretly recording her without her consent, using that information to harass her. Ailes, who <a href="https://www.nexttv.com/news/roger-ailes-resigns-fox-news-406531" data-original-url="https://www.multichannel.com/news/roger-ailes-resigns-fox-news-406531">resigned</a> from Fox News in July 2016 in the wake of the Gretchen Carlson harassment scandal, died last May.  Shine, who was named in other harassment suits, resigned from the channel in May 2017. </p><p>In his decision, Judge Daniels wrote that Tarantos failed to back up her digital harassment claims with evidence.</p><p>“Plaintiff’s amended complaint is based primarily on speculation and conjecture,” Judge Daniels wrote. “Moreover, she fails to adequately make out the basic elements of her claims.”  </p>

The <em>Journal</em>, like Fox, is controlled by the Murdochs. A final decision on O’Reilly could come as early as the next several days, the paper said.<br/><br/>In <em>New York</em> magazine, Gabriel Sherman <a href="http://nymag.com/daily/intelligencer/2017/04/sources-the-murdochs-are-turning-against-bill-oreilly.html">reported</a> that the Murdochs are leaning toward announcing that O’Reilly will not return to the air.<br/><br/>One factor pushing the Murdochs is a pending ruling on 21st Century Fox’s $14 billion takeover of Sky TV in Europe, according to the magazine. The British Office of Communications is getting ready to rule on whether Fox is a “fit and proper” owner for Sky. Parting with O’Reilly would make Fox appear more squeaky clean to regulators by removing at least one potential objection.<br/><br/>According to <em>The New York Times</em> a <a href="https://www.nytimes.com/2017/04/18/business/media/fox-bill-oreilly.html">new complaint</a> from a former Fox News employee was registered on the 21st Century Fox sexual harassment hotline. The employee said that in 2008 that O’Reilly would leer at her, grunt like a “wild boar” and called her “hot chocolate.”<br/><br/>The <em>Times</em> said O’Reilly’s lawyer, Marc Kasowitz of Kasowitz Benson Torres, said it was “outrageous that an allegation from an anonymous person about something that purportedly happened almost a decade ago is being treated as fact.”<br/><br/>Kasowitz also said O’Reilly “has been subjected to a brutal campaign of character assassination that is unprecedented in post-McCarthyist America.”<br/><br/>“This law firm has uncovered evidence that the smear campaign is being orchestrated by far-left organizations bent on destroying O’Reilly for political and financial reasons. That evidence will be put forth shortly, and it is irrefutable,” Kasowitz said.<br/><br/>Ailes has also denied all of the charges made against him.</p>

                                <p>21st Century Fox executive chairman Rupert Murdoch and his son, CEO James, saw their fiscal 2016 total compensation rise in the double-digit percentages, according to a proxy statement filed with the Securties and Exchange Commission Friday.</p><p>Rupert Murdoch, who <a href="https://www.nexttv.com/news/rupert-murdoch-hand-over-ceo-reins-july-1-391436" data-original-url="https://www.multichannel.com/news/rupert-murdoch-hand-over-ceo-reins-july-1-391436">handed over the CEO reins to his sons James last year</a>, his other son Lachlan was named executive chairman as well, received $34.6 million in total compensation in fiscal 2016, 24% increase from the $27.9 million he received in fiscal 2015. The biggest difference for Rupert being a near doubling of his pension value and non-qualified deferred compensation to $11.1 million from $5.6 million a year earlier.</p><p>For James, who has taken an increasingly visible role in the company along with his brother – they both were instrumental in the recent <a href="https://www.nexttv.com/news/roger-ailes-resigns-fox-news-406531" data-original-url="https://www.multichannel.com/news/roger-ailes-resigns-fox-news-406531">ouster of Fox News Channel chairman Roger Ailes, </a> received $26.4 million in total compensation in fiscal 2016, a 75% increase over the $15.1 million he received in the prior year.  James Murdoch’s biggest increases cane in the form of stock awards ($10.1 million vs. $5.4 million in 2015) and pension value and deferred compensation ($5.6 million vs. $916,000).</p><p>Lachlan Murdoch, who r<a href="https://www.nexttv.com/news/report-rupert-murdoch-hand-fox-reins-son-james-391286" data-original-url="https://www.multichannel.com/news/report-rupert-murdoch-hand-fox-reins-son-james-391286">ejoined the company in 2014</a> as non-executive chairman after nine years away running his own investment firm in Australia, made $23.7 million. The proxy did not list compensation for Lachaln for fiscal 2015.</p><p>Fox SVP and chief financial officer John Nallen received $12.1 million in total compensation for the year, up 47.6% from $8.2 million in fiscal 2015. Former executive vice chairman Chase Carey, who agreed to become <a href="https://www.nexttv.com/news/liberty-media-buy-formula-one-44-billion-407569" data-original-url="https://www.multichannel.com/news/liberty-media-buy-formula-one-44-billion-407569">chairman of Liberty Media’s Formula One Group</a> once that deal closes, received $29.2 million in total compensation, up 26% from $23.2 million the year before. According to the proxy statement, Carey has been a consultant to 21st Century Fox and a member of its board of directors since July.</p>

While Ailes denied the charges, several other women have come forward since Carlson’s suit making similar allegations. <a href="https://www.nexttv.com/news/roger-ailes-resigns-fox-news-406531" data-original-url="https://www.multichannel.com/news/roger-ailes-resigns-fox-news-406531">Ailes resigned</a> later that month after Fox conducted an internal investigation into the matter.</p><p>According to people familiar with the settlement, Fox will foot the entire bill. Ailes <a href="http://www.nytimes.com/2016/07/22/business/media/roger-ailes-fox-news.html?_r=0">reportedly walked away</a> from Fox with about $40 million when he resigned, essentially the remainder of his employment deal with the company, which was set to expire in 2018.</p><p>Carlson sued Ailes in part to avoid an <a href="http://fortune.com/2016/07/11/gretchen-carlson-roger-ailes-arbitration/">arbitration clause</a> in her contract with Fox, according to several reports. Ailes’s lawyers tried to have the case dismissed initially because they believed it violated that clause, but those efforts have obviously been abandoned.</p><p>“21st Century Fox is pleased to announce that it has settled Gretchen Carlson’s lawsuit,” the company said in a statement.  “During her tenure at Fox News, Gretchen exhibited the highest standards of journalism and professionalism. She developed a loyal audience and was a daily source of information for many Americans. We are proud that she was part of the Fox News team. We sincerely regret and apologize for the fact that Gretchen was not treated with the respect and dignity that she and all of our colleagues deserve.”</p><p>According to <a href="http://www.vanityfair.com/news/2016/09/fox-news-settles-with-gretchen-carlson-for-20-million">Vanity Fair,</a> citing people familiar with the matter, 21st Century Fox will pay Carlson $20 million in the  settlement. The <a href="http://www.nytimes.com/2016/09/07/business/media/fox-news-roger-ailes-gretchen-carlson-sexual-harassment-lawsuit-settlement.html?emc=edit_na_20160906&nlid=63287592&ref=cta&_r=0">NewYork Times also reported</a> Tuesday that Fox is in settlement talks with other women at the network.</p><p>"I am gratified that 21st Century Fox took decisive action after I filed my Complaint. I'm ready to move on to the next chapter of my life in which I will redouble my efforts to empower women in the workplace," Carlson said in a statement. "I want to thank all the brave women who came forward to tell their own stories and the many people across the country who embraced and supported me in their #StandWithGretchen. All women deserve a dignified and respectful workplace in which talent, hard work and loyalty are recognized, revered and rewarded."</p>

Fox News said it does not comment on pending litigation.</p><p>Tantaros said in the suit, “Fox News masquerades as a defender of traditional family values, but behind the scenes, it operates like a sex-fueled, Playboy Mansion-like cult, steeped in intimidation, indecency, and misogyny.”</p><p>Tantaros also charged that Ailes did not act alone. “He may have been the primary culprit, but his actions were condoned by his most senior lieutenants, who engaged in a concerted effort to silence Tantaros by threats, humiliation and retaliation,” her suit said.</p><p>She added that 21st Century Fox’s top execs, Rupert, James and Lachlan Murdoch, “have been misleading the public into believing that they are taking action. In fact, they have done the opposite.”</p><p>In the suit, Ailes is accused of making inappropriate comments like “turn around so I can get a good look on you” -- a request so common at Fox News it was referred to as “The Twirl” -- and “I bet you look good in a bikini.”</p><p>“Perhaps the most shocking encounter of all,” the suit said, “was a Spring 2015 meeting between Tantaros and Fox News senior xxecutive, defendant William Shine, during which Tantaros sought relief from Ailes’s sexual harassment. In response, Shine told Tantaros that Ailes was a ‘very powerful man’ and that Tantaros ‘needed to let this one go.’ Yet, after Ailes was revealed to be a sexual predator and forced to resign, Shine was promoted to co-president of Fox News. In the wake of Carlson’s lawsuit, several other former and current female Fox employees have reportedly come forward with similar claims.</p><p>According to a report in New York Magazine earlier this week, Fox parent 21st Century Fox CEO James Murdoch, and co-executive chairmen Lachlan Murdoch and Rueprt Murdoch had agreed that Ailes should leave the company, but couldn’t agree on timing. According to the report, Rupert and Lachlan wanted to wait until after the Republican National Convention to oust Ailes, while James wanted it to occur this week. Tonight is the last night of the RNC, where nominee Donald Trump, a Fox News staple, is scheduled to make his acceptance speech.</p><p>Rupert Murdoch will assume Ailes’ duties as chairman and acting CEO of Fox News Channel and Fox Business Network. </p><p>“Roger Ailes has made a remarkable contribution to our company and our country.  Roger shared my vision of a great and independent television organization and executed it brilliantly over 20 great years,” Rupert Murdoch said in a statement. “Fox News has given voice to those who were ignored by the traditional networks and has been one of the great commercial success stories of modern media. And the only agreement that is in place is his existing employment agreement.  "</p><p>The last part of the statement was in reference to reports that Ailes is set to receive a $40 million severance package on his departure.</p><p>Ailes has been under fire ever since former Fox & Friends anchor Gretchen Carlson alleged that Ailes had sexually harassed her on several occasions, firing her recently after she again refused his advances. Since then several women, former and current Fox employees, have come forward to attorneys investigating the allegations, saying that Ailes too had sexually harassed them. Fox News anchor <a href="http://nymag.com/daily/intelligencer/2016/07/sources-kelly-said-ailes-sexually-harassed-her.html" data-original-url="http://nymag.com/daily/intelligencer/2016/07/sources-kelly-said-ailes-sexually-harassed-her.html#">Megyn Kelly</a>, who had been strangely silent as other on-air personalities defended Ailes (including Bill O'Reilly, Maria Bartiromo and Greta Van Susteren) reportedly told those same attorneys that Ailes had made sexual advances toward her 10 years ago.</p><p>According to a <a href="http://nymag.com/daily/intelligencer/2016/07/murdochs-have-decided-to-remove-roger-ailes.html">New York Magazine report</a> by Ailes' unofficial biographer Gabriel Sherman, 21st Century Fox CEO James Murdoch had been pressing for Ailes' immediate ouster, while his brother, executive chairman Lachlan and his father executive chairman Rupert were in favor of waiting until after the Republican National Convention this week to pull the trigger.   </p>

Since Carlson filed her suit several other former and current Fox female employees <a href="http://money.cnn.com/2016/07/09/media/roger-ailes-accusations-gretchen-carlson/">have reportedly come forward</a>, claiming Ailes had made unwanted sexual overtures to them over the years. Ailes has vehemently denied the allegations, and other Fox on-air personnel have come to his defense, including Bill O’Reilly, Greta Van Susteren, Maria Bartiromo, Geraldo Rivera and others.</p><p>According to the <a href="http://nymag.com/daily/intelligencer/2016/07/murdochs-have-decided-to-remove-roger-ailes.html">magazine</a>, 21st Century Fox CEO James Murdoch, his brother executive chairman Lachlan Murdoch and their father, executive chairman Rupert Murdoch have agreed that Ailes must go. According to the report by Gabriel Shearman, a long-time chronicler of the Murdoch family and Fox, James Murdoch is pushing for the company to give Ailes a choice of either stepping down or being fired by the end of the week. Lachlan and Rupert, according to Sherman, are holding out that any moves wait until the conclusion of the Republican National Convention this week.</p><p>The news comes as Fox’s lawyers – Paul, Weiss, Rifkind, Wharton & Garrison – are continuing their <a href="https://www.nexttv.com/news/fox-launches-internal-review-ailes-allegations-406162" data-original-url="https://www.multichannel.com/news/fox-launches-internal-review-ailes-allegations-406162">investigation</a> of the claims against Ailes.</p><p>In a statement, Fox said, “This matter is not yet resolved and the review is not concluded.” </p><p>The 76-year-old Ailes is largely credited with building Fox News Channel from scratch into a ratings powerhouse, consistently placing as the top channel in cable news for more than a decade. The network is run separately from Fox’s other programming units, and generates upwards of $1 billion in profit for 21st Century Fox each year.                                 <figure class="van-image-figure pull-" data-bordeaux-image-check ><div class='image-full-width-wrapper'><div class='image-widthsetter' ><p class="vanilla-image-block" style="padding-top:56.25%;"><img id="SxZWTNcCU6BiFZaXXkSDAU" name="" alt="" src="https://cdn.mos.cms.futurecdn.net/SxZWTNcCU6BiFZaXXkSDAU.jpg" mos="https://cdn.mos.cms.futurecdn.net/SxZWTNcCU6BiFZaXXkSDAU.jpg" align="" fullscreen="" width="" height="" attribution="" endorsement="" class="pull-"></p></div></div></figure><p>21st Century Fox said it has begun an internal review of the sexual harassment charges made against Fox News chairman Roger Ailes by former anchor Gretchen Carlson.</p><p>Carlson alleges in <a href="https://www.nexttv.com/news/fox-news-anchor-gretchen-carlson-files-suit-against-roger-ailes-406147" data-original-url="https://www.multichannel.com/news/fox-news-anchor-gretchen-carlson-files-suit-against-roger-ailes-406147">a lawsuit filed in New Jersey</a> that she was fired after she rejected Ailes's advances and spoke up about conditions in the Fox News Channel newsroom.</p><p>In a statement, 21st Century Fox said it has is “taking these matters serious,” but maintained it has “full confidence in Mr. Ailes and Mr. Doocy, who have served the company brilliantly for over two decades.”</p><p>At the same time Ailes released a statement of his own, denying the allegations.</p><p>“Gretchen Carlson’s allegations are false," Ailes said. "This is a retaliatory suit for the network’s decision not to renew her contract, which was due to the fact that her disappointingly low ratings were dragging down the afternoon lineup. "Her questioning of Mr. Trump at the debate was tough but fair, and I fully support her as she continues to ask the probing and challenging questions that all presidential candidates may find difficult to answer. Donald Trump rarely apologizes, although in this case, he should. We have never been deterred by politicians or anyone else attacking us for doing our job, much less allowed ourselves to be bullied by anyone and we’re certainly not going to start now. All of our journalists will continue to report in the fair and balanced way that has made Fox News Channel the number one news network in the industry.”     </p><p>Trump&apos;s initial attacks on Kelly stemmed from some tough questioning by her and other Fox anchors in the first Republican presidential debate. Trump had appeared to be <a href="https://www.nexttv.com/news/update-trump-makes-friends-fox-news-392904" data-original-url="https://www.multichannel.com/news/update-trump-makes-friends-fox-news-392904">trying to mend fences with the channel</a> in the interim, but after Monday night&apos;s tweets, the fence was clearly in need of repair once again.</p><p>Trump&apos;s press office had not responded to multiple e-mails at press time, but a statement <a href="http://www.politico.com/blogs/media/2015/08/roger-ailes-donald-trump-should-apologize-to-megyn-212934.html">cited by Politico</a> had Trump doubling down again, saying he disagreed with Fox and that he didn&apos;t think Kelly was a "quality journalist."</p>

She launched weekday market show <em>Opening Bell with Maria Bartiromo</em> on FBN on Feb. 24, and bowed <em>Sunday Morning Futures with Maria Bartiromo</em> March 30 on FNC before 1.08 million viewers, more than doubling the audience of CNN and MSNBC and nearly matching that feat in the news demo of adults 25 to 54. <em>Multichannel.com</em> news editor Mike Reynolds recently sat down with Bartiromo to discuss her shows’ early performance and the move to Fox, where she has been reunited with an old friend, Fox News president Roger Ailes. An edited transcript follows.</p><p><strong>Multichannel News: What’s the transition been like?</strong></p><p><strong>Maria Bartiromo:</strong> The show is similar because it's a market show, two hours, live. The Sunday show has been just a complete, new, energizing, refreshing thing for me.</p><p>I find that everyone is working really hard here. They know they're number one and they're busy. They're going to keep being number one and they’re doing their job. But everybody has been unbelievable; they've really made it easy for me, going out of their way to welcome me.</p><p>Shepherd Smith sent me flowers. Bill O'Reilly took me in his office and just chatted me up. Judge Napolitano said ; “When can you have coffee?” They are all - Jeanine Pirro as well - they are all being so wonderful to me. So I think that the warmth that they have shown me has been just so great and I appreciate them all.</p><p><strong>MCN: It's good to work on Sundays?</strong></p><p><strong>MB:</strong> I love it. I mean the show, I love. It's hard working six days, I guess. But I just got the numbers and we beat CNN and MSNBC combined every week since we launched. So I feel like that tells you right there that there is an appetite for economic angles and business information on a Sunday.</p><p><strong>MCN: You identified that as an opportunity?</strong></p><p><strong>MB:</strong> Yeah, it was. I like to watch TV on a Sunday morning with my coffee. I used to just flip around watching who everybody had. And what I realized was that while you see all these politicos talking about the issues of the country -- whether it's the economy, whether it's foreign policy -- very few of them actually connect the dots and actually say and identify the fact that it's about jobs.</p><p>And so I was talking about that in a Sunday show and I brought it to Roger [Ailes] and he loved the idea and said business can be part of the solution. And I said, right, I agree. So with his help and with  [FNC EVP of programming] Bill Shine and [FNC EVP of news] Michael Clemente offering their visions, together we came up with this idea.</p><p><strong>MCN: On Sunday and overall, you're taking a longer-form approach?</strong></p><p><strong>MB:</strong> Increasingly over the last couple of years, what I have heard from CEOs and guests is the fact that it feels too short term. What I kept hearing from them was things like, 'Maria, you had me on for five minutes, I came all the way here and it's a complex story and I can't really tell my story in five minutes.'</p><p><strong>MCN: Plus, you have three other guests on at the same time.</strong></p><p><strong>MB:</strong> Right. Well I was under pressure to have four and five people on at once. In the Nineties, it was all about the stock market; it was dotcom boom and then dotcom bust. People wanted these short, sound-bite situations.</p><p>But I think over time audiences have changed, frankly. I think they want analysis, they want perspective</p><p>So we're definitely trying to have guests on for longer. We don't have a set time. I mean I had James Gorman, the CEO of Morgan Stanley on for an hour. I had Steve Schwartzman, the CEO of Blackstone Group, on for an hour. But then we had John Donahoe, the CEO of eBay, we had him on for fifteen minutes. You don’t do everyone for an hour.</p><p><strong>MCN: Is part of the appeal here to help boost Fox Business Network</strong>?</p><p><strong>MB:</strong> Fox News Channel is the leading cable network, so I've got that support behind me for the Sunday show and that's phenomenal. Fox Business Network is a little more of a build-out situation and I know that and it's not going to happen overnight. This team has done a great job in six years. I'm here because I want to help them build this network, because I think people do want an alternative. For Fox Business Network, I feel like I have already had incredible success because I have had guests on the air that have never walked through the building. I mean I am having the highest of the high in corporate America on the show every day. So I think as long as we do a good show, the numbers come later.</p><p><strong>MCN: What about working with Roger again?</strong></p><p><strong>MB:</strong> One of the reasons I came here frankly was because I did want to reunite with Roger Ailes. I like him a lot. He is very smart, very savvy about branding, about television. And he put me on the air twenty years ago. I mean he saw something in me, he believed in me, and I have always had the highest regard for him.</p><p>I think another reason was because I've seen Bill (Shine) and Michael Clemente and Brian Jones in action. Kevin Magee used to work with me as well at CNBC, and he’s running Fox Business Network. I like him a lot. When I looked at the overall management team, I thought these guys know what they're doing.</p><p><strong>MCN</strong>: <strong>The way contracts work, you had sixty days between jobs. How did you handle that?</strong></p><p><strong>MB:</strong> Well, it was tough. I like to work. In twenty years I must have taken two weeks off at a clip, right? I mean do you ever take more than two weeks off? No one does.</p><p>Even knowing that there was a chance I was going to leave, I was booking December and I shouldn't have. But I had a commitment to Governor Cuomo, who asked me if I would moderate his Regional Economic Awards Program in Albany. I had a commitment that I said I would go to the White House Holiday Dinner.</p><p>Then it was the holidays. I should have, in retrospect, gone away to the Caribbean, put my feet up and not done anything, but I didn't.  Then I finally realized okay, I am going to be working soon…</p><p><strong>MCN: For a long time…</strong></p><p><strong>MB:</strong> I better do something because I'm not going to have a vacation. So I went to Milan with my sister. We went to La Traviata at La Scala Opera House. Then we went to see the Last Supper painting, which is absolutely spectacular. And then I went hiking with my husband in Arizona for two and a half weeks with my husband,  So I did have some time off. And then I went to Davos that was also in my schedule.</p><p>And I’m really happy I did because it was very important for me to be able to communicate to people why I left and why I was starting a new job.</p><p><strong>MCN: What big names are you trying to get for Sunday?</strong></p><p><strong>MB:</strong> I'm trying to look at the issues of the day with an economic angle. That's really my mandate. And so I'm not going to take the guests that are doing their rounds on <em>Meet the Press</em> and Bob Schieffer. If John Kerry decides do the rounds, we probably won't take him because I am not going to do the same show that's out there right now, I want to do everything through an economic lens.</p><p>So the first program we led with [economist] Larry Summers, and his take on the economy, his take on the Fed. Then, it was the weekend of Obama Care so then we had Toby Cosgrove, the CEO of Cleveland Clinic. We had [former director of the National Economic Council] Gene Sperling. So I'm trying to get in every show a policy maker, yes, and a regulator, yes, but also an economic person, whether it's a CEO or someone who was the Treasury Secretary.</p><p>So I don't really have these must-gets in my head. I am trying to lean into the week ahead. We were the first show to show [author] Michael Lewis's quote, ‘The market is rigged,’ and have Larry Summers react to it and then that following week everybody was going crazy over it.</p><p><strong>MCN: So, it’s an advantage playing on Sunday?</strong></p><p><strong>MB:</strong> Yeah, I think so.</p>
