                                <p>Reps. Anna Eshoo (D-Calif.) and Republican Whip Steve Scalies (R-La.), who have <a href="https://eshoo.house.gov/news-stories/anna-in-the-news/broadcasting-and-cable-scalise-reintroduces-video-reform-bill/">both long called for an overhaul of the retransmission consent system</a>, have called for an end to the Nexstar/DirecTV retrans impasse. </p><p>That came <a href="https://eshoo.house.gov/wp-content/uploads/2019/07/Eshoo-Scalise-letter-to-Nexstar-and-ATT-re-July-2019-blackout.pdf">in a letter Tuesday (July 16)</a> to the heads of Nexstar (Perry Sook) and DirecTV parent AT&T (Randall Stephenson). </p><p>The blackout is entering its second week. </p><p><a href="https://www.broadcastingcable.com/news/nexstar-stations-overstate-hill-blackout-letters">Related: Nexstar Stations Overstate Hill Blackout Letters </a></p><p>The legislators, who said they would be teaming up to introduce legislation to fix the "broken system," said they hoped the two companies will work "in good faith" to resolve the blackout ASAP.  </p><p>The companies are actually under a congressional and FCC mandate to negotiate in good faith. </p><p>The tone of the letter was cordial and, in fact, talked more about the process writ large and said blackouts were a symptom of the larger problem, "outdated and ineffective laws" that harmed consumers and hampered innovation and that they pledged to fix in the near future. </p><p>The legislators took the opportunity to ask the companies to support pending legislation, but in the meantime, said they should continue their "good faith" negotiations. </p><p>The two sides met over the weekend but no resolution was forthcoming.</p>

                                <p>Rep. Anna Eshoo (D-Calif.) will get together with opponents of the proposal to reverse the Title II classification of internet access.</p><p>According to an e-mail notification on the June 19 event, it will be held at the headquarters of Mozilla (Firefox), which is participating in a July 12 protest and has been encouraging Web surfers to oppose FCC Chairman Ajit Pai's proposal to reclassify ISPs as information services and rethink the rules against blocking, throttling and paid prioritization.</p><p>The event is billed as one with stakeholders, but it also says that it is a "roundtable to discuss the impacts of net neutrality and the consequence of eviscerating the policy." Presupposing that rolling back Title II is the equivalent of eviscerating Title II indicates the stakeholders are ones with a stake on one side of the issue.</p><p>Eshoo's office characterizes the Title II rollback as "removing protections that advance competition, innovation, small businesses and entrepreneurs, benefitting only the interests of the largest Internet Service Providers (ISPs)."</p><p>That is borne out by the list of participants, which includes Gigi Sohn former counselor to FCC Chairman Tom Wheeler and a big booster of his Title II-based 2015 Open Internet order; Chris Riley of Mozilla.</p><p>Eshoo, who represents Silicon Valley, where computer companies are generally Title II fans, has been on of the strongest voices for maintaining that common carrier definition of ISPs.</p>

                                <p>Rep. Anna Eshoo has introduced a bill she suggests could vaccinate computer networks against the "majority of hacks."</p><p>The Promoting Good Cyber Hygiene Act is billed as building on President Obama's executive order directing the creation of voluntary best practices for network security. That includes "establishing" through legislation those "voluntary" best practices.</p><p>Eshoo is actively seeking co-sponsors, with a source saying the bill had some computer industry endorsements, including from Oracle.</p><p>The bill would help combat cybercriminals by:</p><p>1. "Establishing a baseline set of voluntary best practices;<br/>2. "Ensuring these practices are reviewed and updated annually;<br/>3. "Making the established best practices available in a clear and concise manner on a publicly accessible website; and<br/>4. "Instructing the Department of Homeland Security to study cybersecurity threats relating to mobile devices."</p><p>“Our nation’s computer networks—public and private—are under constant attack from cyber criminals,” Eshoo said in introducing the bill. “It’s estimated that these attacks cost our economy nearly half a trillion dollars annually in identity theft, stolen blueprints, exposed financial information, and more...“Our digital world is imperfect, but this is not an acceptable excuse for the millions of consumers who’ve had their identities stolen, their bank accounts drained or their credit destroyed, especially if it could have been prevented.”</p>

The committee plans to focus some attention this session on FCC process, including how it makes regulatory decisions, and efforts to restore network neutrality rules, according to the c<a href="http://docs.house.gov/meetings/IF/IF00/20150109/102806/HMTG-114-IF00-20150109-SD003.pdf)">ommittee majority's oversight plan</a>.</p><p>The committee held its first meeting in the new Congress, an organizational meeting to vote on the rules, and which was billed by in advance as pretty much a pro forma exercise. Some legislators were certainly exercised over the Republican proposal. That subpoena power change--adopted 28 to 23--highlighted a contentious start that belied the evocations at the beginning of the meeting of the general bipartisan nature of the committee. The vote was purely along party lines except for chairman emeritus Joe Barton (R-Tex.), who voted against the move, and after some harsh words from Democrats.</p><p>Rep. Bobby Rush (D-Ill.) called it a cheap power grab, and ranking member Frank Pallone (D-N.J.) called it a terrible precedent for potential abuse of power, saying it was a "huge mistake" that moved the committee in the wrong direction.</p><p>Rep. Anna Eshoo 9D-Calif.) said it Upton had a record of thoughtful policy decisions and suggested this did not fit that mold. She said it was not like him to "come out of the box this way," with a rule change that "casts aside" the bipartisan partnership Upton has talked about.</p><p>She said undermining that "advise and consent" role was not good government.</p><p>Upton pointed out that six other committees in the last Congress had given their chairman the power, that he would use it only as a last resort, and that it would enhance the committee's investigative capabilities. He said it would allow the committee to act quickly to "leverage" cooperation. He said there would be no change in the bipartisan nature of investigations and the committee would attempt to get voluntary cooperation wherever possible and consult with minority "where practicable."</p><p>The committee rules in the last Congress required the chairman to consult with the ranking member, and if they could not agree, to call for a vote of the committee before issuing a subpoena.</p><p>The new rules would not require that, but it would require that the chairman notify the minority and, "where practicable," 72 hours before issuing the subpoena. Ranking member Frank Pallone (D-N.J.) said that "where practicable" was a loophole he wanted closed, but the language stayed in the rules as voted.</p><p>The Democrats said the change made them feel marginalized, and while they did not expect Upton to abuse the privilege, they were worried about the precedent it set. They also asked what problem needed fixing, given that there no examples in the last Congress of subpoenas the chairman wanted that did not get issued, and that if the chair and the ranking member could not agree, the majority had enough votes to approve a subpoena.</p><p>They also said that it was no argument for the rules that other committees did it, and they would rather have other committees emulating the comity of E&C.</p><p>They all said they did not think Upton would misuse his power, but that giving the chair, any chair, the unchecked authority to issue subpoenas was a bad precedent and an un-bipartisan way to kick off the new committee.</p>

Frank Pallone (D-N.J.) has been elected ranking member of the House Energy & Commerce Committee, making him the top Democrat on the committee that shares oversight of communications.</p><p>He is succeeding Henry Waxman (D-Calif.), who is retiring at the end of the current congressional session.</p><p>Pallone had the seniority, but ranking Communications Subcommittee member Anna Eshoo (D-Calif.) had also been in the running.</p><p>The chairman of the committee is Fred Upton (R-Mich.).</p><p>Pallone will be starting his 14th term in January. He has been mostly focused on environmental and healthcare issues, rather than communications, while Eshoo has been a prominent voice in network neutrality, retrans and media consolidation issues, not to mention championing the Commercial Loudness Mitigation Act (CALM).</p>
