                                <figure class="van-image-figure pull-" data-bordeaux-image-check ><div class='image-full-width-wrapper'><div class='image-widthsetter' ><p class="vanilla-image-block" style="padding-top:56.25%;"><img id="VAa5X8PuunESdqT8FEzJUc" name="" alt="" src="https://cdn.mos.cms.futurecdn.net/VAa5X8PuunESdqT8FEzJUc.jpg" mos="https://cdn.mos.cms.futurecdn.net/VAa5X8PuunESdqT8FEzJUc.jpg" align="" fullscreen="" width="" height="" attribution="" endorsement="" class="pull-"></p></div></div></figure><p>A top advisor to FCC chair Ajit Pai said the agency could not hold another big spectrum auction like the broadcast incentive auction or the previous AWS-3 wireless spectrum auction, both of which freed up spectrum for more and faster wireless broadband.<br/><br/>Rachael Bender, in a speech to the 6th Annual Americas Spectrum Management Conference in Washington, said the potential "stumbling block" on the path to the rollout of 5G mobile broadband is that while the law allows the FCC to keep auction upfront payments in an interest-bearing account, as a result of financial regulations on collateralizing deposits, no financial institution is willing to hold such payments in an interest-bearing account.<br/><br/>Related: FCC Accepts Latest Batch of Auction License Applications<br/><br/>As a result, she said flatly, "So the Commission currently has no way to comply with the law or move forward with a large spectrum auction."<br/><br/>Bender said the good news is an FCC reauthorization bill that was referred to the full House Energy & Commerce Committee this week.<br/><br/>One provision of that multi-provision bill would fix the issue and clear the way for more auctions, she said: The bill would direct the upfront payments to be held by the Treasury instead.<br/><br/>"Getting this proposal signed into law would have a big impact on our ability to move forward with the mid-band and high-band spectrum auctions that are necessary for 5G deployment," she said.<br/><br/>The bill was referred unanimously, but there remain issues that will have to be hammered out in the full committee, said some Democrats this week. Those include how much funding will go to broadcasters for repacking their channels in the wake of the FCC's most recent big auction, the broadcast incentive auction.</p>

                                <figure class="van-image-figure pull-" data-bordeaux-image-check ><div class='image-full-width-wrapper'><div class='image-widthsetter' ><p class="vanilla-image-block" style="padding-top:56.25%;"><img id="Pe6mj79b8CYjMAMh9nRhiD" name="" alt="" src="https://cdn.mos.cms.futurecdn.net/Pe6mj79b8CYjMAMh9nRhiD.jpg" mos="https://cdn.mos.cms.futurecdn.net/Pe6mj79b8CYjMAMh9nRhiD.jpg" align="" fullscreen="" width="" height="" attribution="" endorsement="" class="pull-"></p></div></div></figure><p>According to the FCC, the second stage of the forward portion of the FCC’s broadcast incentive auction—which only launched Wednesday—went only one two-hour round, is now closed and the FCC will have to move to yet another round of reverse auction broadcasters bidding at a lower clearing target.</p><p>There was no one immediately available for comment, but the FCC's website said that "Bidding in the forward auction has concluded for Stage 2 without meeting the final stage rule and without meeting the conditions to trigger an extended round."</p><p>That one round of the forward auction ended with only $21,519,907,210 bid. That is below the closing bid total for round one of the forward, not surprising given that there was less spectrum up for bid, though that could also have boosted the price if demand stayed the same given the reduction in supply.</p><p>Clearly the $56.5 billion broadcasters were asking—this time 114 MHz (90 MHz minus the guard bands) down from 126 MHz (100 MHz minus guard bands)—was still too rich. Forward auction bidders weren't ready to <a href="https://auctiondata.fcc.gov/public/projects/1000/reports/product_status-stage2">up their bids from last time</a>, and they took no time in making that clear.</p><p>The closing after one round means that demand for spectrum in the top 40 markets (actually top 40 geographic areas dubbed PEAs) was not sufficient for the bidders to up their price for the decreased supply.</p><p>Once that happens, even if there is bidding still going on in markets below the top 40, the FCC closes the stage, as happened in this case, and now moves to stage three of the reverse auction, at what will likley be the 108 MHz clearing target.</p><p>"This is a complicated auction design and no significance should be attached to interim steps.  As supply contracts in future stages I am confident that the auction will become more competitive leading to a successful conclusion," said Preston Padden, former executive director of the Expanding Opportunities for Broadcasters Coalition.</p><p>The FCC said it would issue further guidance next week on when stage three of the reverse auction would begin, and at what clearing target.</p><p>The FCC has eleven different spectrum targets, the next being 108 MHz. Some see the 84 MHz as the potential equilibrium point between broadasters' asks and forward bidders' pocket books.</p><p>The second stage of the FCC's reverse portion of the spectrum incentive auction <a href="http://www.broadcastingcable.com/news/washington/reverse-auction-closes-broadcasters-new-exit-price-546b/160312">closed last Thursday (Oct. 13)</a>. It took 53 rounds for broadcasters to come up with their selling price, but only one for forward auction participants in teh top markets to come up with their counter.</p><p>“NAB is surprised by the results of wireless carrier bidding in the second stage of the FCC’s TV auction. Broadcasters look forward to the third stage of bidding and a successful completion of the auction," the National Association of Broadcasters said in a statement.</p><p>NAB has been primarily focused on stations remaining in the broadcasting business, so is eager for a resolution so the FCC can focus on repacking stations post-auction and helping those broadcasters roll out a new, interactive, ATSC 3.0 transmission standard.</p><p>Scott Bergmann, VP of regulatory affairs for CTIA, which represents the wireless carriers, did not sound surprised by the auction lightning round.</p><p>“We always expected the incentive auction to be a multi-staged process," he said, something the FCC has emphasized. "We continue to believe this auction will produce spectrum for the wireless industry that’s key to our nation’s economy and meeting consumer demand.”</p><p>"The rapid close of the second stage of the forward auction shows just how delicate the balance of supply and demand is for the 600 Mhz spectrum in question," said Dan Hays, analyst with PwC Strategy& .</p><p>"The lack of upward motion in the total forward auction proceeds may be disheartening to many broadcasters, who were eagerly awaiting a further narrowing of the gap after reducing their own clearing cost by over 35% just last week. However, it is important to remember that this is all taking place very much by design; the auction is working as planned in an attempt to find a level of spectrum clearing where supply matches demand."</p>

                                <p>TV-station group owner Sinclair says that  it could realize as much as $2 billion were it to put spectrum in the upcoming broadcast incentive auction with minimal impact, which it could decide to do while still being involved in the new ATSC 3.0 next generation transmission standard, which Sinclair has long promoted.</p><p>That is according to Sinclair COO David Amy on the broadcast group's second-quarter earnings conference call Wednesday (Aug. 5).</p><p>"We continue to evaluate spectrum auction opportunities," Amy said, "and based on the Greenhill report on median prices, believe there could be opportunities for us to relinquish licenses with an aggregate value of approximately $2 billion...and still participate in the potential business models that come with ATSC 3.0." He said that the eventual outcome would "depend on the many auction variables that are unclear at this time."</p><p>The FCC is planning to <a href="https://www.nexttv.com/news/fcc-delays-action-spectrum-auction-rules-392229" data-original-url="https://www.multichannel.com/news/fcc-delays-action-spectrum-auction-rules-392229">vote on some of those</a> on Aug. 6, including the bidding structure for the reverse auction.</p><p>Sinclair, which once <a href="http://www.broadcastingcable.com/news/washington/sinclair-challenges-incentive-auction-court/134131">asked a federal court</a> to block the incentive auction, has long been a proponent of broadcasters holding on to their spectrum to take advantage of new technologies that will allow them to be broadband players, and CFO Chris Ripley said its position has not changed regarding that, or its appetite for the auction. But he also said the company has a fiduciary responsibility to weigh auction participation (which can include moving channels or sharing as well as giving up spectrum entirely).</p><p>He said there is a market perception that the company does not want to participate, which Sinclair wanted to clarify.</p><p>What he said had changed recently was that more specifics have come out about the auction to allow Sinclair to quantify for investors what the potential for the broadcaster could be and help "solidify our optimal strategy," which is to maximize shareholder value" and "the auction is a means to do that."</p><p>Ripley said the $2 billion analysis does not "contemplate" the impact of channel sharing, though he said the company was in active discussions about sharing, "which could only make the outcome better," he added.</p>

                                <p>Add Democratic Sens. Ed Markey (Mass.), Al Franken (Minn.), Richard Blumenthal (Conn.), Maria Cantwell (Wash.) and Ron Wyden (Ore.) to the list of legislators asking the FCC to use the broadcast incentive auction to reduce the concentration of low-band spectrum.</p><p>FCC Chairman Tom Wheeler has already proposed setting aside 30 MHz in the forward wireless auction for competitive a carriers to dominant low-band spectrum holders AT&T and Verizon, though T-Mobile and some advocacy groups had pushed for 40 MHZ to make room for even more potential competition.</p><p>The FCC is also proposing to set aside some of the best low-band spectrum for the reserve, which means spectrum without potential impairments from broadcasters and wireless operators sharing the same or adjacent channels in nearby markets.</p><p>In a letter Wednesday (<a href="http://www.markey.senate.gov/imo/media/doc/2015-06-24-Incentive%2520Auction-letter.pdf">http://www.markey.senate.gov/imo/media/doc/2015-06-24-Incentive%20Auctio...</a>), the senators did not mention any particular size reserve, but said as the FCC "moves toward a final vote [planned for July 16], it should "continue to evaluate its auction rules to ensure they prevent excessive concentration of spectrum among the nation's largest wireless providers," which they pointed out meant AT&T and Verizon.</p><p>They said that the auction legislation they helped produce was meant to ensure competition in the wireless market and avoid excessive concentration.                                 <p>Federal Communications chairman Tom Wheeler said Thursday he thought the agency's decision, one way or the other, about whether Dish Network-connected designated entities deserved $3 billion in bidding credits (discounts) in the AWS-3 auction would not delay the upcoming broadcast incentive auction.</p><p>Responding to a question by Todd Shields of Bloomberg following the FCC's May meeting Thursday (May 21) about whether a decision against Dish and the DEs would mean having to re-auction the spectrum, and thus potentially postpone the planned early 2016 incentive auction, Wheeler said he did not think so, adding that the "question that exists" in the AWS-3 auction is the DEs' discount. "If there is a decision made that that is inappropriate," he said, the FCC would not re-auction the spectrum; rather, the DEs would have to pay an additional $3 billion.</p><p>Wheeler later conceded that the ultimate penalty -- some have suggested Dish and the DEs colluded, while Dish and the DEs have said the rules clearly allowed their collaboration -- could be re-auctioning the spectrum, but he added, "The rules as they stand right now are: 'Pay three billion dollars more.'"</p>
